Understanding Wetland Regulations

New York regulates freshwater wetlands through the DEC (Department of Environmental Conservation) for wetlands of 12.4 acres or larger and their 100-foot adjacent areas. The Army Corps of Engineers regulates all wetlands, including smaller ones, under the federal Clean Water Act. Tidal wetlands have separate regulations.

Wetlands and their buffer zones restrict development — you cannot fill, grade, drain, or build in regulated wetlands without permits, and permits are difficult to obtain. The practical effect for property sales is that wetland areas reduce the usable (buildable or improvable) portion of the parcel.

Valuation and Pricing

Properties with significant wetland areas should be priced based on the usable, buildable acreage — not the total acreage. A 10-acre parcel with 6 acres of wetlands has only 4 acres of usable land. Pricing the property as though all 10 acres are usable leads to overpricing and buyer frustration.

However, wetlands are not valueless. They can provide aesthetic value (water features, wildlife habitat, natural screening), prevent neighboring development (protecting views and privacy), and contribute to the property's character. Your agent should price the property realistically while marketing the positive aspects of the natural features.

Disclosure and Documentation

Disclose known wetlands, provide any wetland delineation maps or permits, and ensure the listing description accurately represents the property. Stating '10 acres' without mentioning that 6 acres are wetlands is misleading and will create problems during due diligence.

If you have had a professional wetland delineation performed, provide it to buyers — this is valuable information that saves the buyer time and money and demonstrates transparency. If you have wetland permits for past work (driveways, buildings, improvements), provide those as well to show what has been approved and completed within the regulatory framework.
